The worst part.<\/p>\n\n\n\n<p>Oddly enough, many people don\u2019t actually know <a href=\"https:\/\/en.wikipedia.org\/wiki\/Eviction\">what an eviction<\/a> is. Sure, it\u2019s the act of expelling a tenant from a property.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>It\u2019s the act of expelling a tenant from property, LEGALLY<\/p><\/blockquote>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>The Formal Eviction Process<\/strong><\/h4>\n\n\n\n<p>The&nbsp;formal eviction process&nbsp;is as follows:<\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>Terminate the lease\/form contract with\u00a0proper notice<\/li><li>When the tenant doesn\u2019t leave, file an action with the local court<\/li><li>Attend a hearing<\/li><li>Win the judgement<\/li><li>Hire (make an appointment) with the police<\/li><li>Show up on \u201ceviction day\u201d with the police, reclaim possession of the unit<\/li><li>Change the locks<\/li><\/ol>\n\n\n\n<p>A \u201cself-help eviction\u201d (lock-outs, or utility shut-offs) is usually illegal, and it gets thousands of landlords in trouble every year.<\/p>\n\n\n\n<p>To recap above,&nbsp;the first step of any eviction is to terminate the lease or agreement. In order to terminate a fixed-term lease early,&nbsp;you must have a valid reason, or \u201cjust cause\u201d, to do so. Month-to-month agreements can be terminated fairly easily with very little notice \u2013 usually 30 days.<\/p>\n\n\n\n<p>When it comes time to\u00a0go to court, the judge will ask \u201cwhy are you asking me to remove this tenant from your unit?\u201d What will your response be?<\/p>\n\n\n\n<p style=\"color:#77c720;font-size:11px\" class=\"has-text-color\"><a href=\"https:\/\/kenyahomes.co.ke\/blog\/how-eviction-works-what-renters-need-to-know\/\">Related: How Eviction Works: What Renters Need to Know<\/a><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>5 Legitimate Reasons to Evict a Tenant<\/strong><\/h3>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>1. Nonpayment of Rent<\/strong><\/h4>\n\n\n\n<p>The most common reason for lease termination and eviction is nonpayment of rent.<\/p>\n\n\n\n<p>It\u2019s an easy concept to understand: \u201cif you don\u2019t pay, you can\u2019t stay\u201d. Most courts and judges are reasonable about this and make little exceptions to allowing a non-paying tenant to remain in the unit.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>\u2026if you don\u2019t pay, you can\u2019t stay.<\/p><\/blockquote>\n\n\n\n<p>With that said, if a landlord is failing to provide a habitable dwelling, then sometimes, nonpayment of rent is overlooked.<\/p>\n\n\n\n<p><strong>Note:<\/strong>\u00a0\u201cnonpayment of a late fee\u201d is not the same as \u201cnonpayment of rent\u201d. Most courts will not award a landlord a judgement solely for unpaid late fees.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>2. Lease Violation<\/strong><\/h4>\n\n\n\n<p>The second most common reason for eviction is when a tenant violates a lease clause.<\/p>\n\n\n\n<p>Many violations can allow the landlord to terminate the lease if the issue is not corrected quickly (anywhere from 3-30 days). Here are the most common lease violations:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Unauthorized Pets<\/strong><br>Having pets when none are allowed, or having more pets than what is allowed.<\/li><li><strong>Extended&nbsp;Guests or Unapproved Occupants<\/strong><br>Many residents think that they can move their boyfriend or girlfriend into the unit without asking \u2013 for as long as they want. However, most leases don\u2019t allow any occupants other than those listed on the lease (for good reason). Unapproved occupants, or \u201cRogue Tenants\u201d can be a completely legal and liability nightmare.<\/li><li><strong>Unapproved Subletting<\/strong><br>Most leases grant a resident \u201cexclusive\u201d rights to occupy the dwelling. This means that the landlord can\u2019t rent it to anyone else, but it also means the tenant is under the same restriction. Most thorough leases prohibit subletting without prior approval, so let\u2019s hope your tenant remembers to ask before&nbsp;putting your unit on Airbnb&nbsp;while spending the summer in Italy.<\/li><li><strong>Improper Use<\/strong><br>Many administrative or home-based business is allowed to operate out of a residential dwelling, but sometimes a tenant will take it too far. A \u201cresidential\u201d lease should be used for residential purposes, and not occupied by a high-traffic business.<\/li><li><strong>Nuisance Complaints<\/strong><br>The neighbours (and the police) will only put up with so many loud parties. If \u201cenough\u201d noise\/nuisance complaints are filed against your tenants, the police department will actually fine the landlord. At the first sign of trouble, it\u2019s wise to remind your tenants that repeat noise complaints are a lease violation (assuming you put it in your lease).<\/li><\/ul>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>3. Property Damage<\/strong><\/h4>\n\n\n\n<p>We\u2019ve all heard the wild stories of tenant damage. Sadly, the majority of tenant damage is not intentional \u2013 but rather caused by a lack of common sense. <\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>4. Illegal or Drug-Related Activity<\/strong><\/h4>\n\n\n\n<p>When a resident is committing a crime, the police, and the local government want to know about it. There is very little grace granted to drug-dealers.<\/p>\n\n\n\n<p>In most areas, a landlord can terminate a lease with 24 hours (or sometimes less) notice for drug or crime-related activity.<\/p>\n\n\n\n<p>A landlord can even immediately terminate the lease of a tenant who is convicted of public indecency! Yikes!<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>5. Expiration of Lease<\/strong><\/h4>\n\n\n\n<p>Every good thing must eventually come to an end. But sometimes, a tenant refuses to move out, and now you have a squatter.<\/p>\n\n\n\n<p>If the lease has naturally expired or terminated with&nbsp;proper notice, then the tenant no longer has any right to occupy the dwelling.
